The road to resolution

  1. What happened

Our client was a passenger in a car travelling through a village at around 80mph. The driver lost control and the car hit a pub wall. As a passenger, our client had no say in how the car was driven.

The bone around our client’s eye was fractured in two places, and nerve damage has caused a loss of vision. They also suffer regular severe headaches, anxiety and post-traumatic stress.

  2. How we helped

Solicitors at NJS Law brought the claim against the driver’s insurer. We arranged independent medical evidence covering the eye injury, the vision loss and the psychological effects.

We then negotiated with the insurer until the claim was resolved.

  3. The outcome

Our client received £100,000 in compensation.

Questions people ask

Can a passenger claim if the driver they were with caused the crash?

Yes. Passengers can usually claim against the insurance of the driver who caused the accident, even when that is the driver of the car they were travelling in. The claim is dealt with by the driver’s insurer, not the driver personally.

Can I claim for anxiety or PTSD after a car accident?

Yes. Psychological injuries such as anxiety and post-traumatic stress can form part of a claim alongside physical injuries. Independent medical evidence is used to show how the accident has affected you.
