What can I claim for?
Compensation covers your injury and the financial impact it has had on your life.
Your injury
An amount for pain, suffering and the effect on your daily life, based on how serious it is and how long it lasts.
Lost earnings
Time off work and any future loss of income caused by your injury.
Treatment and rehab
Medical treatment, physiotherapy and prescriptions. Rehab can often be funded early.
Travel to appointments
The cost of getting to medical appointments and treatment.
Care and help
Help from family or friends while you recover, as well as paid care.
Damaged belongings
Personal items damaged in the accident, such as phones, clothing or riding gear.
Who can make a road accident injury claim?
Anyone hurt in a road accident caused by someone else may be able to claim.
- Drivers
- Passengers, including in a friend's or family member's car
- Motorcyclists
- Cyclists
- Pedestrians
- Taxi, van and commercial drivers
Passengers can usually claim even if their own driver caused the accident, because the claim is made against the driver's insurer, not the driver personally.
Key things to know
Before you start an injury claim.
Time limit
Usually three years from the accident. For children, it starts on their 18th birthday.
How it's funded
If your claim isn't successful, you won't pay NJS Law's fees. If it succeeds, a success fee and any insurance premium may be deducted. Every cost is explained first.
Whiplash reforms
Many lower-value claims for adult drivers and passengers go through the Official Injury Claim service. Cyclists, motorcyclists, pedestrians and children are treated differently.
Partly to blame? You may still be able to claim, although your compensation may be reduced.

Road accident injury FAQs
Can I claim if I was partly to blame?
Often, yes. If you were partly at fault, for example by not wearing a seatbelt, you may still be able to claim, but your compensation may be reduced to reflect your share of the blame.
Can I claim against a friend or family member who was driving?
Yes. The claim is made against the driver's insurer, not the driver personally, so it shouldn't cost them anything directly.
Do I need to have seen a doctor?
It helps. Getting medical advice soon after the accident is important for your health and creates a record of your injury. If you haven't seen anyone yet, it's not too late.
How much compensation could I get?
It depends on how serious your injury is, how long it lasts and what it has cost you. Every claim is different, so an estimate can only be given once there is medical evidence.
Can I get help with rehabilitation?
In many claims, the at-fault insurer can be asked to fund treatment such as physiotherapy early on, to help your recovery.
