Cycling accident claims when a driver was to blame

Help for cyclists hurt or left out of pocket after a collision with a vehicle.

The short answer

If you were hit by a driver while cycling, you can usually claim from their insurer for your injuries, your bike, damaged kit and costs such as lost earnings. Cyclists aren't covered by the 2021 whiplash reforms, and you can still claim if you weren't wearing a helmet, although it can sometimes affect the amount.

What can cyclists claim for?

Your claim can cover your injury and everything the accident cost you.

Your injury

Compensation for pain, suffering and the effect on your daily life.

Your bike

Repair or replacement, including e-bikes and specialist bikes.

Clothing and kit

Helmets, lights, clothing, shoes and devices damaged in the accident.

Lost earnings

Time off work, now and in the future, if your injury affects it.

Treatment and rehab

Physiotherapy and other treatment, which can often be funded early.

Travel costs

Getting to work and appointments while you can't ride.

Key things cyclists should know

The rules give cyclists extra protection on the road.

Highway Code

Hierarchy of road users

Since 2022, drivers of larger vehicles have the greatest responsibility to reduce the danger they pose to cyclists.

Not covered

By the whiplash reforms

Cyclists' injury claims don't go through the Official Injury Claim service.

No helmet?

You can still claim

Helmets aren't a legal requirement. In some cases not wearing one may reduce compensation for a head injury.

Common cycling accidents

The collisions cyclists tell us about most often.

Car doors

A driver or passenger opens a door into your path.

Left hooks

A vehicle overtakes you, then turns left across your path.

Close passes

A driver overtakes too closely and clips you or forces you off the road.

Junction pull-outs

A driver pulls out of a side road without seeing you.

Roundabouts

A driver fails to give way to you on or entering a roundabout.

Rear-end collisions

Hit from behind by a vehicle that didn't slow down.

What helps a cycling accident claim?

Any of these will make your claim stronger.

  • The driver's details and registration
  • Helmet or handlebar camera footage
  • Photos of your injuries as they heal
  • GP or hospital records
  • Receipts for your bike and kit
  • Witness names and phone numbers

Hit by a driver who didn't stop? Report it to the police quickly. You may still be able to claim through the Motor Insurers' Bureau.

Can I claim if I wasn't wearing a helmet?

Yes. Helmets aren't a legal requirement for cyclists in the UK. If a helmet would have reduced a head injury, compensation may be reduced, but it doesn't stop you claiming.

Who pays for my bike if it was damaged?

The at-fault driver's insurer is responsible for repairing or replacing your bike, as well as damaged kit and accessories.

Do the whiplash reforms apply to cyclists?

No. Cyclists are treated as vulnerable road users, so the 2021 whiplash reforms and the Official Injury Claim service don't apply to their injury claims.

What if I was hit by a car door?

A driver or passenger who opens a door without checking is usually responsible. Witness details and camera footage help show what happened.

What if the driver didn't stop?

Report it to the police as soon as possible. You may still be able to claim through the Motor Insurers' Bureau, which deals with untraced drivers.
