Pedestrian accident claims when a vehicle hit you

Help for pedestrians injured by cars, vans, motorbikes and other vehicles.

The short answer

If you were hit by a vehicle while walking, you can usually claim compensation from the driver's insurer for your injuries and costs such as lost earnings, treatment and travel. Pedestrians aren't covered by the 2021 whiplash reforms, and if the driver didn't stop, you may still be able to claim through the Motor Insurers' Bureau.

Injury claims are handled by solicitors at NJS Law, authorised and regulated by the SRA (No. 8006550).

Pedestrian accident FAQs

Quick answers to the questions we’re asked most. Can’t see yours?

Call 0800 820 3860

Can I claim if the driver didn't stop?

You may be able to claim through the Motor Insurers' Bureau, which deals with untraced drivers. Report the accident to the police as soon as possible, as strict time limits apply.

What if I was partly to blame?

You may still be able to claim, although your compensation may be reduced to reflect your share of the blame. Drivers are expected to take extra care around pedestrians.

Can I claim if I was hit by a cyclist?

Possibly. Cyclists don't need insurance by law, so it depends on whether they have cover, for example through home insurance or a cycling membership.

Can I claim for my child?

Yes. A parent or guardian can usually claim on a child's behalf. Children also have until three years after their 18th birthday to claim for themselves.

Do the whiplash reforms apply to pedestrians?

No. Pedestrians are treated as vulnerable road users, so the 2021 whiplash reforms and the Official Injury Claim service don't apply.
