What happened
Our client waited for the green man and started to cross the road. A driver ran into him and drove over his right foot. One step further into the road, and the outcome could have been far worse.
He suffered three broken toes and a fracture across the whole top of his right foot.

How we helped
Solicitors at NJS Law brought the claim against the driver’s insurer. We set out that our client was crossing on a green signal when the driver hit him, and arranged an independent medical report on the fractures and his recovery.
We then negotiated until the claim was resolved.

The outcome
Our client received £12,500 in compensation.

Questions people ask
What if the driver says they didn’t see me on the crossing?
Not seeing a pedestrian is rarely a defence. Drivers must keep a proper lookout, stop at red lights and give way to pedestrians on a crossing. Evidence such as witness statements or CCTV can help show what happened.
How long do I have to claim after being hit by a car?
In most cases you have three years from the date of the accident to start an injury claim in England and Wales. There are exceptions, including for children, who have until their 21st birthday, and for people who lack the mental capacity to claim.
