How we helped
Solicitors at NJS Law brought the claim against the driver’s insurer. We arranged independent medical reports covering the fracture, the spinal and foot injuries and the whiplash, and set out how the injuries affected our client’s daily life.
We then negotiated until the claim was resolved.

The outcome
Our client received £32,500 in compensation.

Questions people ask
Who is at fault when a pedestrian is hit crossing the road?
It depends on the circumstances. Drivers must keep a proper lookout and drive at a speed that lets them stop safely, and the Highway Code places the greatest responsibility on the road users who can cause the most harm. Pedestrians also need to take care when crossing, so fault can sometimes be shared. When it is, compensation is usually reduced rather than ruled out.
Do the whiplash reforms apply to pedestrians?
No. Pedestrians are treated as vulnerable road users, so the fixed whiplash tariff and the Official Injury Claim portal do not apply to their injury claims. Their claims follow the standard process instead.
