Knocked off a motorbike while overtaking slow traffic

A driver in slow-moving traffic pulled out as our client was overtaking, knocking them off their motorbike and into a layby.

What happened

Our client was riding their motorbike when they came up behind three or four vehicles in slow-moving traffic. They overtook the first three vehicles on the right-hand side.

As they reached the fourth vehicle, its driver pulled out slightly, then pulled back in as if to let them pass. As our client began to go past, the driver pulled out again, knocking them off their bike and into a layby at the side of the road.

How we helped

Our client’s injury claim was handled by the solicitors at NJS Law, who pursued compensation on their behalf from the party responsible for the accident.

The outcome

NJS Law secured £20,000 in compensation for our client. Every claim is different, and the amount awarded depends on the circumstances of each case.

Can I still claim if I was overtaking when I was hit?

Overtaking doesn’t automatically mean you were to blame. Fault depends on what each road user did. Where both sides are found partly responsible, compensation is usually reduced to reflect that rather than ruled out altogether.
